Spott — Terms of Service

These Terms of Service ("Terms") govern your use of Spott (the "app"), operated by Nolan Severns ("we"). Reading them is part of being on the app. If you don't agree, don't use it.

1. Eligibility

You must be 18 years of age or older to use Spott. You must have the legal capacity to enter into a binding contract. By creating an account you represent that this is true.

If we learn you are under 18 we will permanently terminate your account.

2. Your account

You agree to:

  • Provide accurate sign-up information (email + DOB).
  • Keep your password secret.
  • Use one account per person; don't impersonate another person.
  • Be responsible for all activity under your account.

We reserve the right to suspend or terminate accounts for any reason including, but not limited to, violation of these Terms, harassment of other users, evasion of bans, or use of automated tools (bots, scrapers).

3. Acceptable use

You agree NOT to:

  • Harass, threaten, stalk, dox, or sexually exploit any user.
  • Post nudity, sexually explicit content, or content depicting minors in any context. (Bare chest is fine. Genitalia is not.)
  • Post content that promotes illegal activity, violence, hate against protected groups, or self-harm.
  • Solicit, advertise, or transact sex work or escort services through the app.
  • Spam, phish, or send unsolicited bulk messages.
  • Impersonate another real person, public figure, or account.
  • Scrape, mirror, or otherwise mass-extract data from the app.
  • Reverse-engineer, decompile, or attempt to circumvent the app's technical protections (verification, rate limits, content moderation).
  • Upload malware, viruses, or any harmful code.

We use a combination of automated content moderation (Google Cloud Vision SafeSearch on every uploaded photo) and human review. We may remove content, suspend, or permanently ban accounts that violate these Terms.

4. Content you post

You retain ownership of the photos, voice intros, prompt answers, and messages you post.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, transmit, and back up your content for the purpose of operating the app. This license ends when you delete the content or your account, except for log-level safety records (block / report / ban entries).

You confirm that you have the legal right to post any content you upload, and that the content does not infringe a third party's rights.

5. Verification + DMs

DMs only work between two verified profiles. Verification is done manually by reviewing a selfie you upload. Approval is at our sole discretion. We may revoke verification at any time if we have reason to believe a profile is fraudulent.

6. Privacy

Use of the app is also governed by our Privacy Policy. Read that document for details on what we collect and why.

7. Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee that the app will be uninterrupted, error-free, or secure.

We do not background-check, screen, or monitor users in person. You are solely responsible for your interactions with other users. Meet in public the first few times. Tell a friend where you'll be.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, lost profits, or lost data, arising out of or related to your use of the app.
  • Our total liability for any claim arising from these Terms or the app is limited to USD $100 or the amount you paid us in the past 12 months (whichever is greater — and Spott is currently free).

Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permissible by law.

9. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, or damage arising from (a) your use of the app, (b) your violation of these Terms, or (c) your violation of any third-party right.

10. Termination

We may suspend or terminate your account at any time for any reason or no reason, with or without notice. You may delete your account at any time via Settings → Account → Delete account.

Upon termination, your right to use the app ends immediately. Sections 4 (license to your content), 7 (disclaimer), 8 (limitation of liability), 9 (indemnification), and 11 (governing law) survive.

11. Governing law + disputes

These Terms are governed by the laws of the State of Oklahoma, United States, without regard to conflict-of-laws principles.

Any dispute arising from or relating to these Terms or the app will be brought exclusively in the state or federal courts located in Cleveland County, Oklahoma, and you consent to the personal jurisdiction of those courts.

If a class-action waiver is unenforceable in your jurisdiction, this provision does not apply.

12. Changes to these Terms

We may update these Terms periodically. Material changes will be announced in-app. Your continued use after the changes take effect constitutes acceptance.
